Following is the summary of the order for your understanding:
- Barrister Shahnawaz Noon informed the Islamabad High Court that the government of India is deliberating regarding the appointment of a lawyer to assist the Court in the effective implementation of the judgement of the International Court of Justice (“ICJ”) relating to Commander Jadhav.
- The Attorney General on behalf of the Government of Pakistan reiterated Pakistan’s offer of 3rd consular access to India.
- The Islamabad High Court stated that the Court wants to ensure a fair trial for Commander Jadhav and it wants to carry out a meaningful and effective implementation of the judgment of the ICJ. However, the court reemphasized that this onerous task requires the Government of India to extend meaningful assistance.
- The Court concurred with the Attorney General’s proposition that it is legally impermissible under local laws to allow an official Indian High Commission to exchange dialogue at the bar.
- The Court concluded that in order to achieve a meaningful and effective implementation of the judgment of the ICJ, all legal principles enunciated in the ICJ judgment and all of Pakistan’s domestic laws have to be followed.
- The Court stated that it expects Indian Government to take appropriate decisions which will facilitate the Islamabad High Court in implementing the ICJ judgment. Furthermore, the court asked barrister Malik Shahnawaz Noon to inform the court of any reservations the Indian Government may have in extending its assistance in the Khulbushan Jadhav case.
- The next date for the hearing was fixed for 14.01.2021.
